DMCA Policy
Last updated: March 2, 2026
Introduction
Image Tool Hub ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our Service that are reported to our Designated Copyright Agent.
It is important to note that Image Tool Hub processes all files entirely in your browser using client-side technology. Your images, videos, audio files, PDFs, and Word documents are never uploaded to our servers, and we do not store or have access to your files. However, we take copyright protection seriously and will respond to valid DMCA notices regarding any content that may appear on our website (such as our own text, images, or code). Users are responsible for ensuring they have the right to process any content they use with our tools.
The DMCA provides a safe harbor for online service providers who meet certain conditions. We comply with the DMCA's requirements and have designated an agent to receive notifications of claimed infringement. This policy explains our procedures and your rights and obligations. We take copyright seriously and will act promptly on valid notices.
Designated Copyright Agent
If you are a copyright owner or an agent thereof, and you believe that any content on Image Tool Hub infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
Image Tool Hub DMCA Agent
Email: dmca@imagetoolhub.com
Please include "DMCA Takedown Request" in the subject line.
We will only accept written communications sent to this agent. Emails must be in English. Incomplete or improperly formatted notices may delay our response. We may request additional information if a notice is unclear. For counter-notifications, use the same contact with "DMCA Counter-Notification" in the subject line.
DMCA Takedown Notice Requirements
To be effective, your DMCA takedown notice must include the following information:
- Physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of copyrighted work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of infringing material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including URLs or specific page references).
- Contact information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- Statement of good faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that do not substantially comply with these requirements may not be valid and may not trigger our obligation to remove content. We may contact you to request clarification or additional information. Providing false information in a DMCA notice may subject you to liability under Section 512(f) of the DMCA.
Processing of DMCA Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Review the notice for completeness and validity
- Remove or disable access to the allegedly infringing content (where we have control over such content)
- Notify the user who posted or used the content (if applicable and if we have contact information)
- Provide the user with an opportunity to file a counter-notification
- Maintain records of all DMCA notices and actions taken
We will process valid DMCA notices expeditiously and in good faith. However, please note that because Image Tool Hub processes files entirely in the user's browser, we typically do not have access to or control over user files. If the allegedly infringing content is hosted on our website (e.g., our own images or text), we will remove it. If the content was processed by a user locally, we cannot remove it—we recommend contacting the user directly or seeking legal advice.
We will acknowledge receipt of valid notices and will inform the complainant of the actions taken. We may also provide the affected user with a copy of the notice and information about filing a counter-notification. We maintain records of all DMCA notices and our responses for compliance and legal purposes.
Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. To be effective, your counter-notification must include:
- Physical or electronic signature: Your physical or electronic signature.
- Identification of removed content: Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled.
- Contact information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. The original complainant will then have 10 business days to file a court action seeking a court order to restrain you from engaging in infringing activity. If no such action is filed, we will restore the removed content.
The counter-notification process is designed to protect users whose content was removed by mistake. If you file a counter-notification, the original complainant may choose to file a lawsuit. We are not a party to any such dispute and will comply with court orders. We recommend consulting an attorney before filing a counter-notification.
Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to terminate accounts that we determine, in our sole discretion, are repeatedly infringing the intellectual property rights of others.
Because Image Tool Hub does not require user accounts for most tools, we may use other means to identify repeat infringers, such as IP addresses or device identifiers. We reserve the right to block access from users or networks we determine to be repeat infringers. We may also report repeat infringement to appropriate authorities.
False Claims
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. We reserve the right to seek damages from any party that submits a false or fraudulent DMCA notice.
We may also share information about false or abusive notices with other service providers or legal authorities. Submitting a DMCA notice is a serious matter—ensure you have a good faith belief that the material infringes your copyright before submitting. When in doubt, consult an attorney.
User Responsibility
Users of Image Tool Hub are responsible for ensuring that they have the legal right to process any files they use with our Service. You agree not to use the Service to process copyrighted material without proper authorization from the copyright owner. By using our Service, you represent and warrant that:
- You own the rights to any content you process, or
- You have obtained proper authorization from the copyright owner, or
- Your use of the content constitutes fair use under applicable copyright law
We do not monitor the content users process. If you believe your copyrighted work has been infringed by someone using our tools, please contact that user directly. If you believe content on our website (e.g., our own images or text) infringes your copyright, please submit a DMCA notice to our Designated Copyright Agent.
Fair use is a legal doctrine that allows limited use of copyrighted material without permission in certain circumstances (e.g., criticism, comment, news reporting, teaching). Whether a particular use qualifies as fair use depends on the facts. We cannot advise you on fair use—consult an attorney if you are unsure. We will not remove content based on a DMCA notice if we have a good faith belief that the use is protected by fair use or another defense.
Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. We will notify you of any material changes by posting the new DMCA Policy on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated policy.
We may update this policy to reflect changes in the law, our procedures, or best practices. Material changes will be indicated by the "Last updated" date. We encourage you to review this policy periodically. If you have pending DMCA matters, we will apply the policy in effect at the time of your submission, unless otherwise required by law.
